RULES AND REGULATIONS FOR
PELICAN LANDING ASSOCIATION
OF CHARLOTTE COUNTY, INC.
1. If you have guests, you are responsible for their deportment and safety. No more than six adults shall live in a unit. If the unit is leased, the tenant automatically assumes all the use rights of the Association property and common elements otherwise available to owner.
2. Pets:
A. Pets can only be on the premises with a unit owner of record and must be kept on a leash.
B. Pet owners must use the public walkway areas parallel to either side of North Beach Road and must clean up and properly dispose of waste.
C. Condo documents stipulate a pet may not exceed 30 pounds and must be registered with the Management Company.
3. All pedestrian and traffic areas must be unobstructed. Children shall not play with or in elevators. Children shall not be permitted to loiter in or on the common elements. Bicycle riding and skating are for ingress and egress only. Neither carts, motorized or unmotorized, nor remote control toys are allowed at any time on the common elements.
4. The personal property of all unit owners shall be stored within their condominium units.
A. The hanging or placing of laundry of any description upon the exterior of the buildings, on the lawns, or other common elements (pool railings) is prohibited. Management reserves the right to remove any items found in these areas.
B. Storing/leaving personal items in the condominium common areas is prohibited. This includes the passageways, stairways, under the buildings, Clubhouse, and pool area. Management reserves the right to remove any items that are rusty and unusable which are found in the common areas, including items left in the storage rooms under Buildings B and E. These storage areas are to be used by only on-site owners or lessees.
C. No garbage containers may be placed on the common area, but belong in the rubbish rooms under each building. Recyclable items should be put in the appropriate bins. Rubbish must be in plastic bags and secured. Cardboard boxes are to be broken down. No construction trash to be put in rubbish rooms; construction trash should be placed on curb for Thursday pick up.
5. No awnings, window air conditioners, antennas, clotheslines or other projections or objects shall be installed on or attached to any common element. Fire exits shall not be obstructed in any manner within limited common elements and common elements are to be free and clear at all times. Storm (hurricane) shutters matching those that now exist may be installed at owner's option with Board approval. Maintenance is owner's responsibility.
6. Passenger Vehicles
E. No repair work is allowed.
Due to the lack of boat docking space at Pelican Landing, the following will apply during the months of November, December, January, February, March and April.
A. Please contact Stan Gombos (E-105 at 475-5297) or a Boat Committee member for a boat trailer or docking decal; 48-hour notice is required.
B. During the months listed above, a two-week rotation will be used so that all boaters will be able to occupy one slip for at least two weeks. See Stan for rotation schedule.
C. Boats and/or boat trailers are to be parked only on the north side of "E" building. (There are to be no more than five (5) boats and/or trailers at any time parked in the specified area. Trailers must be only for boats using a Pelican Landing dock space. However, a boat/trailer may be parked for 48 hours during a transition period.
D. Storage of boats/trailers during an owner’s absence in off-season is not permitted except for permanent residents on vacation for one month or less.
E. Under no circumstances are boat trailers to be parked under any building.
F. No boat repair work is permitted on the premises.
G. Only on-site owners/tenants are permitted to dock a boat overnight if space is available.
H. Charging of boat batteries is allowed using the electrical outlets on the dock. No extension cord of any kind should cross any dock/deck area.
I. One end of the outside/east side of the dock shall remain open. Temporary docking is permitted for passenger ingress or egress.
J. No trailer storage is permitted without a boat in an available boat slip.
K. No boat docking or boat storage is allowed unless the boat is legally owned by a Pelican Landing condominium owner or tenant.
L. No boat shall be too long as to block access for another boat into a dock space.
M. Boat tie-up at any portion of the bulkhead is not permitted at any time.
8. Electrical Panels-No increase in the capacity per circuit breaker in owners’ individual electrical panels.
9. Clubhouse Usage
A. Office and meeting place for Association members and its Board of Directors.
B. Storage for Association equipment and records, only with Board approval.
C. Social events by one or more unit owner(s) or lessee(s), if reserved prior to event, from the Management company on a first-come basis. The Management Company or Board of Directors has the right to refuse the use of same if, in the opinion of either party, the event may cause a disturbance or annoyance to other unit owners or lessees. The use of the Clubhouse by one or more unit owner(s) or lessee(s) for a private social event will require a deposit of $100.00, which will be returned if the facility is left in the same condition as in was prior to the event. Should damages or cleaning exceed the $100.00 deposit, the Management Company will review the necessary repairs with the unit owner(s) or lessee(s) and agree upon a dollar value for the repairs. Under no circumstances are the Social Committee supplies to be used. Clubhouse must be left in same condition as found if used for private party.
D. All functions of any nature shall conclude on or before 11:00 p.m.
10. Pelican Landing Association assumes no responsibility for damage to or theft of any privately owned equipment parked or stored on the common elements including the pool and dock areas.
11. Structural Changes
A. No unit owner shall allow construction within his/her unit which will impair the structural integrity of the condominium. Any structural changes require the written approval of the Board of Directors.
12. Elevators
A. Elevator use is strictly for the transportation of persons and their personal effects. Any vendor delivery requiring the use of said elevator must have prior permission from the Management Company.
B. Vendors must use proper padding around the object being delivered while in the elevators or on the walkways.
13. Entertainment
The playing of radios, televisions, and stereos shall be at a volume that will not interfere and/or disturb other residents of the condominium. Cellular and cordless phones should not be left unattended.
14. Recreational Facilities
A. At all recreational facilities, including Clubhouse, the bay-side dock and deck and tennis court, children under 16 must be accompanied by an adult.
D. No rusty or unserviceable bikes are to be left in bike racks.
E. No unserviceable beach chairs are to be left in beach storage areas. Name or unit number should be placed on chairs left in these areas.
15. Barbecue grills are not permitted to be used on lanais or walkways. All outdoor cooking must be done at the ground level. It is recommended that self-starting briquettes be used. If charcoal is used, put cold coals in plastic bag and dispose of properly. Grills are not to be emptied and washed on the gravel areas under the buildings. Grills belonging to the Social Committee will be stored in the electrical room under Building "E". Please be considerate of your neighbors regarding smoke and fumes.
16. Pool Rules
A. Shower and remove tanning oil and sand before entering the pool.
B. Children under 16 must be accompanied by an adult.
C. No food, snacks or glass containers allowed in the pool or pool area.
D. No animals in the pool or pool area.
E. No children under 16 are permitted in the Jacuzzi (spa).
F. Bathing load - twenty (20) persons.
G. Warning--No lifeguard on Duty.
H. Emergency assistance - DIAL 911.
I. Children in diapers are required to wear waterproof diaper (pants).
J. Association chairs cannot be reserved at the pool. Persons bringing their own chairs to the pool area must remove them when leaving the pool area.
K. No rafts or large inflatable toys permitted in the pool.
L. No throwing of any toys or other objects in and around the pool area. This also includes the boat docks and deck.
M. No running, pushing, jumping, or diving in the pool or pool area.
N. Health conditions--use at your own risk. If you have any health conditions or are on any medications, consult your physician before using pool. This pertains mainly to the spa.
